Florida’s Transgender Medicaid Ban Was Unconstitutional
U.S. District Judge Robert Hinkle‘s decision means that all transgender individuals in Florida who qualify for Medicaid should now have access to coverage for their gender-affirming care, according to attorney Simone Chriss, representing the plaintiffs.
Judge Hinkle’s ruling on Florida’s Transgender Medicaid Ban specifically directs the state to reinstate coverage for hormone therapy and puberty blockers for the two adults and two minor plaintiffs involved in the case. For other transgender individuals seeking care, Medicaid coverage decisions will be determined on a case-by-case basis, similar to other health procedures.
Chriss emphasized that this ruling ensures transgender individuals are now subject to the same rules as everyone else. Judge Hinkle’s 54-page decision criticized the state’s law and the AHCA rule, stating that they were established for political reasons.
Florida’s transgender Medicaid ban on gender-affirming care was implemented by the Agency for Health Care Administration last summer, based on an in-house report that questioned the effectiveness of such care.
However, Judge Hinkle stated in his order that the process of creating the report was biased and aimed at justifying a predetermined outcome, rather than conducting a fair analysis of the evidence.
The ruling applies to both the agency’s ban and the ban passed by state lawmakers and Governor Ron DeSantis, which became law in Florida.

Responses to Florida’s Transgender Medicaid Ban Ruling
Representatives for Gov. DeSantis and the Agency for Health Care Administration have not yet responded to requests for comment on the ruling of Florida’s transgender Medicaid ban.
Plaintiff August Dekker, a 29-year-old transgender man from Spring Hill, expressed relief and satisfaction with the decision. Dekker had been denied recommended medical treatment due to Florida’s policy, which impacted his ability to afford necessary healthcare as a low-income individual with disabilities relying on Medicaid.
While this ruling on Florida’s transgender Medicaid ban marks a significant victory, challenges remain. A burdensome informed consent process, part of Senate Bill 254 recently passed in Florida, continues to create barriers to care for transgender adults. Chriss and her legal team are actively working on formally challenging those provisions.
This ruling on Florida’s transgender Medicaid ban follows similar wins for transgender individuals and advocates challenging healthcare bans in other states. Just this week, a federal judge struck down Arkansas’ ban on gender-affirming care for minors, and last week, a federal judge blocked Indiana’s ban from taking effect as planned on July 1.
